Dear Healthcare at Home Colleague,

This is big news. The courts have given Medicare Home Health providers a major victory. This week's lead story is a report from attorney Elizabeth Hogue explaining the meaning of a March 27 decision by the U.S. Court of Appeals for the 5th Circuit in "Family Rehabilitation, Inc. v. Azar." Several years ago, CMS issued a rule change giving itself permission to hold disputed funds until the end of the appeals process. Previously, the care provider had been able to keep the funds during the process. Later, the Administrative Law Judge system experienced a massive backlog of cases, due to the increase in appeals that resulted from a significant number of erroneous payment denials, based on incorrect interpretations of the law. A shocking number of HHAs were forced out of business while waiting for the results of appeals they were likely to win.

In other news, Medalogix has released a new product designed to assist clinical decision-making. This new solution is focused on coordinating care between and among disciplines for the purpose of managing utilization and controlling costs, without sacrificing patient outcomes.
