As Medicare-certified HHAs know, new Conditions of Participation have been published and take effect on July 13. Among the changes are nearly two dozen that will force changes to EMR software. If CMS change strategy remains consistent with past practice, interpretations and instructions to software developers will continue to be released over the next five months, possibly right up to the deadline. Vendors are accustomed to this pressure and will gear up for it but it would be wise to read your vendor's update releases, watch their web site and stay in touch about their plans to keep you compliant with the new rules.

The IMPACT Act is driving some of the more drastic changes. As CMS moves toward the Act's mandate to create a common assessment form for all post-acute providers, the first target is the patient's Plan of Care. Current practice is to set the initial POC in stone and modify it as needed with signed verbal orders from the patient's physician. The new rules turn the POC into a living document. Changes will no longer appear as separate documents stapled to the original POC but will change the POC itself. Every change will require a new physician signature on the plan of care.

One developer, Tom Peth, CEO of Thornberry Ltd., told us he also noticed a mandate that the POC become more patient-directed. "Somehow, patient preferences have to be captured and integrated into the POC," he said. He added that his team will also be working on another mandate, changes in the way aide supervision is tracked.

As always, best practice is to stay in close touch with your vendor as July approaches. If they have a history of meeting regulatory deadlines, you need not worry. While you still may want to keep a close eye on them, however, you have to exercise some empathy at the same time. CMS does not make allowances for the time it takes to modify software, test it for bugs, and distribute it, which makes these transitional times challenging for healthcare software vendors. Last-minute official interpretation changes, tweaks to previous instructions and other speed bumps are common and should be expected.

I remember an interview with a vendor's product manager before a recent OASIS update that took effect on one January 1 deadline. When I asked, "What if CMS issues changes in November or December?" former HealthWyse VP Andrew Braunstein laughed, "Or February!"
