In This Week's News (Again!)We do not mean to keep harping on all the problems CMS is having with its Pre-Claim Review experiment but they seem to force themselves into the headlines week after week. Right after we released last week's issue, CMS published a report on what it characterized as early successes in Illinois, the only state currently subjected to the PCR requirement. It was immediately severely criticized by NAHC's VP for law, Bill Dombi for distorting some facts and ignoring others. We summarize the CMS report and NAHC's critical response for you and provide links to both originals. We also have our own thoughts as to why CMS would release such a slanted document and offer that opinion in our "Tim's Blog" column.

Speaking of criticizing CMS
We also received permission to reprint attorney Elizabeth Hogue's analysis of a recent Federal Appeals Court decision that overturned a MAC payment denial to one home health agency. The judge did not merely write a decision; he admonished CMS for employing contract reviewers who do not even know their own rules. This is the core problem in pre-claim reviews but this judge named the same thing, inadequate reviewer knowledge, in a routine payment denial appeal. Perhaps it is a system-wide problem.

Telehealth reporter Audrey Kinsella offers a preview of her upcoming trip to the 13th annual Partners Connected Health Symposium in Boston. The intersection between technological innovation and high touch care is on the agenda and she will be filing a number of stories over the coming weeks.
